What is an emergency:

• summary dismissal
• a short-notice disciplinary hearing where the response date falls within the closure period
• a major contravention of the EBA where the decision takes effect during the closure period and cannot be reversed
• any issue where time is genuinely of the essence and the deadline falls during the shutdown

What is not an emergency:

• Clause 11s where the response date is after 5 January. Even if this happens, the union can intervene in January and seek extensions or issue a Clause 13 notice for lack of genuine consultation
• disciplinary matters where the response date is after 5 January. Extensions can be requested in the new year
