An Outbreak of Commonsense - Finally

Ballarat Office Refurbishment

On the last weekend in June, builders marched into Ballarat CCS and began the ‘refurbishment’. Despite the lack of a contingency plan for securing the building, client, and staff records, staff were expected to turn up on Monday morning (30 June) and work in a bomb site that was hazardous and completely unsafe to both clients and staff.


Staff, at their own initiative, managed to find some alternate space in the courthouse jury room and moved themselves, their desks and computers.

CPSU then lodged a dispute with the Australian Industrial Relations Commission and a hearing before Deputy President Hamilton was held on Friday 4 July and resulted in CCS being directed to discuss the refurbishment impacts with CPSU and affected members by the following Tuesday 8 July, as per the obligations under the Victorian Public Service Agreement.

Finally some commonsense has prevailed and, after a frank discussion, a range of undertakings were given and these have been confirmed in writing.

These are:

 • That the Department of Justice will write to Karen Batt (CPSU) and to Deputy President Hamilton (AIRC) outlining the actions from the meeting at Ballarat of July 8th.

 • That Acting CCS General Manager, Mr. Phil Pettingill, will be on-site every day for the remainder of the week, to ensure that agreed actions are carried out.

 • That, by close of business on Thursday, CCS will have reviewed alternative accommodation (both current government and commercial premises) in Ballarat. If the accommodation situation does not look favourable by then, CCS will review their actions, subject to discussion.

 • That Mr. David Daley (Director CCS) will write to the Chief Magistrate and the Chair of the Adult Parole Board, to outline the current operational difficulties at CCS Ballarat, with a draft of said correspondence to be provided to the Ballarat office for comment.

 • CCS will organize an appropriate social function when the refurbishment is completed.

 • David Daley will, within 48 hours, write to the appropriate officer in relation to the indemnity of staff against any liability arising as a result of the disruptions to CCS operations.

 • A locksmith to be contracted today to secure files, filing cabinets and CCS premises. Any unsecured files will be securely stored off-site.

 • Security of the building will be further enhanced by the engagement of additional security guards who will be placed where staff want them to be placed.

 • I.T issues – David Daley will urgently request the IT (DOJ) department to ensure adequate access and security of computers and systems, and Phil Pettingill will follow up with Regional IT staff.

 • OHS Issues: CCS acknowledges and welcomes the future assistance of CPSU's OHS officer as an adviser on OHS issues, in conjunction with the local OHS representative.

 • File Audit – CCS agreed that there will be a comprehensive audit of files, at a time to be determined through local consultation.

 • Service Delivery Outcomes:  David Daley will write to the Locations Manager and Seniors to advise that SDO targets for this periods will be “relaxed”.

 • Professional removalists will be engaged for any further movement of furniture /other property. Staff are not expected to do any of this physical work.

 • Emergency Management Plans: Phil Pettingill to follow up with local staff.

 • Arrangements will be made to ensure the video link is accessible and operational.

 • Security Log for the movement of people (such as builders) in and out of the building – Phil Pettingill will follow up.

 • Duress system – CCS will look at what is feasible immediately and Phil Pettingill will clarify with local staff as to what is most appropriate.

 • Immediate task – address the safety and ergonomic issues  associated with the Jury room (Phil Pettingill to action)

 • All CCS members will be kept up to date with progress and movements regarding Ballarat CCS.
